1. Who we are
buyphonesja is a marketplace for buying and selling used phones in Jamaica. We provide the platform — listings, messaging, protected checkout, delivery coordination, and dispute resolution. Sales contracts are between the buyer and the seller; buyphonesja is not the seller of listed items.
2. Accounts
- You must be at least 18 and provide accurate account information. One account per person; you are responsible for activity on your account.
- Sellers receiving card payouts must hold a connected Handypay account and may be asked to complete identity verification.
- We may suspend or close accounts that break these terms, our seller guidelines, or the law.
3. Listings
- Listings must describe a real device the seller possesses, accurately — model, condition, battery health, defects, and what is included.
- Stolen, blacklisted, activation-locked, financed-and-unpaid, or counterfeit devices are prohibited.
- Listings pass automated and human review and may be rejected or removed. Providing false evidence is grounds for removal.
- Once a listing is reserved or attached to an order, it is frozen as the record of sale and can no longer be edited or deleted.
4. Purchases and payments
- Card purchases run through buyphonesja checkout. Payment is held and released to the seller after the buyer's 48-hour inspection window closes, per buyer protection.
- Accepted offers reserve a phone for 30 minutes while the buyer completes checkout; unpaid reservations expire.
- Sellers may offer cash at pickup. Cash sales settle directly between the parties, outside buyphonesja checkout, and are not covered by buyer protection.
- Soliciting or making payment outside buyphonesja for a card checkout listing is prohibited.
5. Fees
buyphonesja charges sellers a 5% marketplace fee on completed checkout sales, deducted from the payout. There are no listing fees. Delivery fees are shown at checkout. Fees may attract GCT as required by law, and fee changes are announced in advance.
6. Delivery and handoff
- Delivery is performed by buyphonesja delivery partners: after payment, the partner collects the phone, checks it against the listing, and delivers it with a photo-confirmed handoff.
- The buyer must accept delivery by signing on the partner's device or providing their delivery code. Phones are not released without one of the two.
- Pickup sales are arranged between the parties; meet in safe, public places.
7. Disputes
Buyers may open a dispute within the 48-hour inspection window. Both parties can submit evidence; buyphonesja moderation decides the outcome, including full or partial refunds, and decisions may be appealed within 7 days. buyphonesja' decision on marketplace disputes is final within the platform and does not limit statutory rights.
8. Conduct
- No harassment, discrimination, spam, fraud, or attempts to move protected transactions off-platform.
- Reviews may only be left by buyers with completed orders and must be honest experiences.
- Content you post (listings, photos, reviews, messages) must be yours to post; you grant buyphonesja a licence to display it on the platform.
9. Liability
buyphonesja provides the platform "as is". To the fullest extent permitted by law, our liability for any claim arising from a transaction is limited to the amounts paid through buyphonesja checkout for that transaction. Nothing in these terms excludes liability that cannot be excluded under Jamaican law, including rights under consumer protection legislation.
10. Privacy
Personal data is handled per our privacy policy and the Jamaica Data Protection Act, 2020.
11. Changes and governing law
We may update these terms; material changes are announced and dated. Continued use after changes means acceptance. These terms are governed by the laws of Jamaica, and disputes are subject to the jurisdiction of the Jamaican courts.
